Acceptable Usage Policy

This AUP governs the usage and utilization of the Multiple C Class IP Hosting services provided by Page1Hosting. Violation of any clause mentioned within this AUP agreement may lead to the SUSPENSION or TERMINATION of your Multiple IP Hosting service. In case of occurrence of a dispute between you and Page1Hosting regarding the interpretation of any particular clause enlisted in this AUP, Page1Hosting’s interpretation in its reasonable commercial judgment shall govern. Please read the AUP thoroughly and refrain from violating any of the terms enlisted in this agreement. If you have any further doubts or questions regarding the AUP, please contact us.

OFFENSIVE CONTENT:

You may NOT transmit/publish using the Multiple C Class IP hosting service provided by Page1Hosting any content that Page1Hosting reasonable believes is:

  1. Unfair or deceptive under the laws of consumer protection prevailing in any jurisdiction. This includes chain letters and misleading pyramid schemes.
  2. Defamatory or violates the privacy of an individual.
  3. A risk to the health or safety of any individua,l poses a risk to safety or health of the public, compromises national security or interferes, in any way, with an investigation carried out by a law enforcement agency.
  4. Material or data that exposes trade secrets or other similar confidential or proprietary information of another individual.
  5. Focused towards helping others in defeating technical copyright protections.
  6. Infringes upon an individual’s trademark, service mark, patent or any other similar property right that is guarded by law.
  7. Promotes illegal drugs, violates export control laws of any jurisdiction, associates to illegal gambling or illegal arms trafficking.
  8. Otherwise prohibited by laws that may be applicable to you or to Page1Hosting.
  9. Otherwise malicious, fraudulent or may result in retaliation against Page1Hosting by offended viewers.

Any content published or transmitted using Multiple C Class IP Hosting services provided by Page1Hosting’s service includes: E-Mails, Bulletin Board Postings, Chat Room messages and any other kind of posting or data transmission/transfer that utilizes or relies upon the Multiple C Class hosting services provided by Page1Hosting.

SECURITY:

You must take reasonable security precautions to prevent any kind of data theft or unauthorized access to your account. Keep your password confidential and don’t share it with anyone. Also, make sure you change it from time to time to minimize risks.

BULK COMMERCIAL EMAILS:

It is compulsory for all existing customers of Multiple C Class IP hosting service brought to you by Page1Hosting to obtain prior permission of Page1Hosting to send out any kind of bulk commercial email, which will NOT be granted unless and until the following conditions are satisfied:

  1. The intended recipients have given you their consent for sending them emails via some affirmative means such as opt-in forms.
  2. The procedure followed for obtaining consent of the intended recipient is not unreasonable and/or deceptive.
  3. Evidence of the consent given by the recipient must be retained to be produced on demand by Page1Hosting within 72 hours of receipt of request of producing this proof.
  4. The body of the e-mail address MUST describe how the e-mail address was obtained.
  5. The e-mail should also contain a procedure that would allow the recipient to easily revoke their consent and delete their name from your mailing list to stop receiving emails in the future.
  6. A privacy policy is essential for each domain associated with your e-mails.
  7. It is compulsory for you to have means to track anonymous complaints.
  8. You must NOT obscure the source of the email in any way. Your email essentially must include the email address of the recipient in the body of the e-mail being sent out OR in the “TO” line of the e-mail.
  9. All your actions must comply with the CAN SPAM act and all other laws applicable to you or Page1Hosting.

These terms and conditions of the AUP apply to ALL messages sent using your Multiple C Class IP Hosting services from Page1Hosting or to messages sent from any other external network by you or on your behalf by any other person that directly or indirectly refers to any of the websites hosted within the network of Page1Hosting including the ones hosted on Multiple C Class IP for SEO purposes. In addition to this, you are also forbidden from using a third party e-mail service that does not follow similar procedures for ALL its customers.

Page1Hosting may test and monitor your compliance with its requirements. This also includes requesting opt-in information from any random sample of your list at any point of time.

UNSOLICITED EMAIL:

You are absolutely forbidden from sending any kind of unsolicited email in bulk or to any particular individual when they have already expressed their wish to not want to receive emails from you in the future.

You must also abide by and follow ALL the rules and regulations of any other network/organization whose services you access while using the Multiple C Class IP hosting services provided by Page1Hosting.

MATERIAL PROTECTED BY COPYRIGHT:

All customers are prohibited from publishing/distributing/transmitting or otherwise copying in any way, any kind of material or data that has been protected by copyright law (this is not limited to but includes: music, software, movies, videos, art etc.) unless:

  1. you have been expressly given the authority to do so by the owner of the copyright for the piece of work/data/material in question.
  2. you are expressly permitted to do so by established United States copyright law to copy the work in that manner.
  3. you own the copyrights to the work/data/material in question.

Page1Hosting WILL terminate the Multiple C Class IP hosting services being provided to people who infringe copyrights and violate copyright laws. COPYRIGHT INFRINGEMENT NOTICE (Digital Millennium Copyright Act):

If you believe that your copyrights are being infringed by an individual/company using the Multiple C Class IP hosting services provided by Page1Hosting or Page1Hosting’s network, please contact us immediately via menthods mentioned on our site.

Your notice must include the following:

  1. A physical or electronic signature of any person given the authority to act on behalf of the owner of exclusive copyrights that have been allegedly infringed.
  2. Identification and proof of the copyrighted work that you claim has been infringed.
  3. Information reasonably sufficient that would allow Page1Hosting to contact you. For example: telephone number, e-mail address, fax no. etc.
  4. A statement that you are positive about the fact that the use of the material in question that has been copied has not been authorized to do so by the copyright owner, an agent or the law.
  5. A statement that all information provided is accurate and precise and under penalty of perjury that you have the authority to act on behalf of the owner of the exclusive right that has been infringed.

INTERNET ABUSE:

You are absolutely forbidden to indulge in illegal, abusive, irresponsible behavior while using the Multiple C Class IP hosting services by Page1Hosting. This includes:

  1. Gaining unauthorized access to or using data, systems or networks. This also includes the act of scanning or testing a system for any vulnerability with the intention of breaching the security or authentication measures without express authorization by the owner of the system or network in question (this includes those belonging to Page1Hosting, any of its customers, agents, employees or suppliers).
  2. Monitoring data/traffic of a particular network of system without the permission of the owner of the system/network concerned.
  3. Causing disruption in the service to any user, host or network including (but not limited to):
    • Mail Bombing
    • Flooding
    • Attempts to overload a system
    • Broadcast Attacks
  4. Usage of an internet account or a computer system without the permission of the owner, including (but not limited to):
    • Password Theft
    • Security Hole Scanning
    • Port Scanning
    • Tricking people into releasing their passwords by some other means
  5. Engaging in forging of a TCP-IP package header or any part of the information in the header in an e-mail or a newsgroup posting.
  6. Any conduct or action of yours that might result in retaliation against the Multiple C Class IP hosting services offered by Page1Hosting.
  7. Using the system or network of Page1Hosting in a manner than reasonably interferes and disrupts the service provided to other clients or users of the same network.

IRC SERVERS

Page1Hosting.com provides Multiple C Class IP hosting services solely for the purpose of Search Engine Optimization. Hosting of any kind of IRC servers on our network is strictly prohibited and any customer found indulging in the hosting of IRC servers may have his/her account immediately terminated without refund!

Peer-To-Peer Networks (P2P)

You are strictly prohibited from using the Multiple C Class IP hosting service provided by Page1Hosting to support any kind of P2P network in any kind of manner. The following is a short list of activities that Page1Hosting.com strictly prohibits:

  1. Hosting trackers
  2. Publishing Bit Torrent, eMule or other similar P2P program links on any website hosted within the Page1Hosting.com network
  3. Running P2P message boards

MISCELLANEOUS

You are required to have valid, accurate and current (up to date) information on file with your domain registrar (For example: WHOIS info) for any domain hosted within the Page1Hosting network.

DISCLAIMER

Page1Hosting.com is under no duty, and does not, by this AUP undertake a duty to monitor or police the activities of our customers. Page1Hosting disclaims ANY responsibility for ANY misuse of the network of Page1Hosting by any of its existing/past customers. NETWORK PERFORMANCE

Multiple C Class IP Hosting service offered to you by Page1Hosting operates on resources shared by numerous clients. Excessive, unreasonable use or abuse of these shared network resources by any particular customer may have a negative impact and/or disrupt the service provided to other clients within the same network. Misuse of shared network resources in this manner which damages the performance of the network is strictly prohibited by this AUP agreement and may result in the termination of service provided to the client abusing the resources without a partial/full refund.

Customers using the Multiple C Class IP hosting service provided by Page1Hosting are prohibited from running websites on the Page1Hosting network that consume excessive server resources including (but not limited to):

  1. CPU Time
  2. Memory
  3. Disk Space
  4. Session Time

Users are requested to refrain from the use of resource intensive programs and applications that can potentially hinder the service to other customers within the Page1Hosting network. Page1Hosting reserves the right to terminate or limit such activities if they occur.
